The black market system has its implacable opponents and vehement supporters. And there are a number of myths circulating around it.
The general explanation is that the švarcsystem is a situation where a formal business relationship exists between a self-employed person and another entrepreneur, but in fact the self-employed person is in the position of an employee .
However, the law does not contain a precise definition. The term “Švarcsystem” itself (named after its “inventor”, businessman Miroslav Švarc) does not appear in it. Švarcsystem falls under the so-called “illegal work”.
Entrepreneurs and companies can sometimes feel confused:
- Is this a svarc system or not yet?
- What should I do to avoid finding myself in this type of relationship?
A great article about the švarcsystem was written by Ivana Lehkoživová from the smluvino law firm. It’s called “Everything you need to know about the švarcsystem” .
What will you learn in it?
- Why can’t you turn a factory worker into an entrepreneur?
- Why does the state’s black market system bother it so much and what attracts some companies to it?
- Why does the fact that a self-employed person invoices only one customer not necessarily mean that it is a švarc system?
If you are dealing with work relationships from any position that could be characterized by the Švarc system, we can highly recommend Ivana’s article.
